Beta License Agreement

This Beta License Agreement ("Agreement") is between you ("Licensee") and Arvestria ("Licensor") and governs your use of the GeoAddIn beta software ("Software"). By downloading or using the Software you agree to be bound by this Agreement.

1. License grant

Subject to the terms of this Agreement, Licensor grants you a personal, non-exclusive, non-transferable, revocable license to install and use the Software solely for your own internal evaluation and testing purposes during the beta period.

2. Restrictions

You may not:

  • Copy, modify, or distribute the Software or any part of it.
  • Reverse engineer, decompile, or disassemble the Software.
  • Sublicense, sell, rent, or lend the Software to any third party.
  • Use the Software for any commercial purpose or on behalf of any third party without prior written consent from Licensor.
  • Remove or alter any proprietary notices or labels on the Software.

3. Beta software disclaimer

The Software is provided as beta software for evaluation purposes only. It may contain errors, bugs, or instabilities and is not intended for use in production environments. Licensor makes no guarantee that the Software will be free from defects or that it will meet your requirements.

4. Expiry

The beta license expires on June 1, 2026. After this date the Software may cease to function. Licensor will notify you before expiry with information about continued access.

5. Feedback

If you provide feedback, bug reports, or suggestions about the Software, you grant Licensor a perpetual, royalty-free, worldwide license to use that feedback for any purpose, including incorporating it into future versions of the Software.

6. Data collection

By using the Software you acknowledge that Licensor may collect certain usage data as described in the Privacy Policy, including download activity and the information you provided at registration.

7. Disclaimer of warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. LICENSOR DOES NOT WARRANT THAT THE SOFTWARE WILL OPERATE WITHOUT INTERRUPTION OR BE ERROR-FREE.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LICENSOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Termination

Licensor may terminate this Agreement and your access to the Software at any time, with or without cause, upon notice to you. Upon termination you must immediately cease using the Software and delete all copies.

10. Governing law

This Agreement is governed by the laws of Belgium, without regard to its conflict-of-law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of Belgium.
